1. Who we are

Trading name: Zonrits

Registered name: [—]

Registered address: Spanje

Company registration number (CIF): [—]

VAT identification number: [—]

Email: info@zonrits.nl

2. Definitions

Consumer: a natural person who is not acting in the course of a trade, business, craft or profession.

Made-to-measure product: a product manufactured according to the consumer’s specifications, such as the dimensions, fabric, colour and fitting type chosen in the configurator.

Agreement: the distance contract between Zonrits and the customer for the purchase of products.

3. Applicability

These terms and conditions apply to every offer and every agreement between Zonrits and the customer. Before the agreement is concluded, the text of these terms is made available electronically so that the customer can easily save it.

Deviations from these terms are only valid if agreed in writing (including by email).

4. Offers and prices

All prices on the website are in euros and include 21% Dutch VAT. The Somfy io motor and delivery within the Netherlands are included in the price, unless explicitly stated otherwise.

The price is calculated by the configurator on the basis of the dimensions and options chosen. Obvious mistakes or errors in the offer do not bind Zonrits.

5. Formation of the agreement

The agreement is concluded when the customer has placed the order and the payment has been successfully completed. Zonrits confirms receipt of the order by email without delay.

The customer is responsible for checking the dimensions and options in the order confirmation. Deviations must be reported within 24 hours of receiving the confirmation, before production starts.

6. Made to measure and right of withdrawal

Zip screens are made to measure according to the customer’s specifications. Pursuant to Article 6:230p(f) of the Dutch Civil Code, the right of withdrawal does not apply to made-to-measure products. The customer is informed of this before placing the order.

For products that are not made to measure (such as a separate remote control), the customer has a right of withdrawal of 14 days after receipt, without giving a reason. The customer must notify Zonrits of this within that period and return the product, unused and in its original packaging, within 14 days of that notification. The direct cost of return shipping is borne by the customer. Zonrits refunds the amount paid within 14 days of the notification, using the same payment method, but may withhold the refund until the product has been received.

7. Measuring

The customer is responsible for measuring correctly and choosing the right fitting type. Zonrits provides measuring instructions and a calculator on the website and is happy to check measurements on request. A product made to the dimensions supplied by the customer is not defective because those dimensions turn out not to fit.

8. Delivery and delivery time

Zonrits delivers within the Netherlands. The delivery time stated at the time of ordering (currently 3 to 5 weeks) is the delivery period agreed with the customer. If Zonrits is unable to deliver within that period, the customer will be informed as soon as possible and may set a reasonable further period; if delivery does not take place within that further period, the customer may dissolve the agreement free of charge and any amount paid will be refunded within 14 days.

The risk of damage to or loss of the products passes to the customer at the moment the products are delivered to the customer or to a third party designated by the customer.

The customer checks the delivery for visible damage upon receipt and reports it to Zonrits as soon as possible, preferably with photos.

9. Installation

Products are supplied for self-installation. The customer installs the product according to the instructions supplied. Fixed connections to the electrical mains must be carried out by a qualified electrician. Damage resulting from incorrect installation or use is not covered by the warranty.

10. Conformity and warranty

Zonrits guarantees that the products comply with the agreement and have the properties required for normal use. The customer’s statutory rights (Articles 7:17 et seq. of the Dutch Civil Code) remain in full force.

In addition to the statutory warranty, Zonrits gives a commercial warranty of 2 years on the zip screen and 5 years on the Somfy motor, calculated from the date of delivery. This warranty does not cover damage caused by incorrect installation, improper use, use in winds stronger than stated in the instructions, normal wear and tear or modifications made by third parties.

11. Complaints

Complaints about the performance of the agreement must be submitted to Zonrits in good time, fully and clearly described, preferably within two months of discovering the defect, via the contact form or by email.

Zonrits will respond to complaints within 14 days of receipt. If a complaint requires a longer processing time, Zonrits will send an acknowledgement of receipt within 14 days with an indication of when a more detailed answer can be expected.

12. Liability

Zonrits is not liable for indirect damage, except in the case of intent or gross negligence. This limitation does not apply insofar as it would conflict with mandatory consumer law.

13. Personal data

Zonrits processes personal data in accordance with the General Data Protection Regulation (GDPR). See our privacy statement for details.

14. Applicable law and disputes

Dutch law applies to all agreements. This does not deprive the consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.

Disputes are submitted to the competent court in the Netherlands. The consumer may always also bring a dispute before the court of their own place of residence.
